Please read the following terms and conditions carefully before using this web site. By accessing or using Promethean’s web site, the user agrees to the following terms and conditions. The user should review these terms and conditions regularly as they may change at any time at our sole discretion. If the user does not agree to any term or condition, then the user should not access or otherwise use this site. “Content” refers to any materials, documents, images, graphics, logos, design, audio, video and any other information provided with, from or on Promethean’s web site.
Promethean’s web site is provided to the user without charge as a convenience and for the user’s information only. By merely providing access to Promethean’s web site content, Promethean does not warrant or represent that:
- The content is accurate, complete, up-to-date or current, though Promethean makes best efforts to keep it so;
- Promethean has a duty to update any content;
- The content is free from technical inaccuracies or typographical errors;
- The content is free from unauthorized changes caused by a third party; and

Promethean’s web site content is provided “as is” and without warranties of any kind, either express or implied. Promethean disclaims all warranties, either express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
Promethean may provide hyperlinks or pointers to other web sites maintained by third parties or Promethean may provide third party content on its own web site. The links to third party web sites are provided for the user’s convenience and information only. The content in such linked web sites is not under Promethean’s control and Promethean is not responsible for such content, including any further links contained within a third party site. If the user decides to access any such third party sites linked to Promethean’s web site, the user does so entirely at the user’s own risk. It is up to the user to take precautions to ensure that the third party links accessed by the user for the user’s own use is free of computer viruses, “worms,” “Trojan horses” and other items of a destructive nature.
Promethean reserves the right to terminate a link to a third party web site at any time and for any reason. The fact that Promethean provides a link to such third party web site does not mean that Promethean endorses, authorizes or sponsors such web site. It also does not mean that Promethean is affiliated with such third party web site’s owners or sponsors.
If a third party links to Promethean’s web site, it is not necessarily an indication of such third party’s endorsement, authorization, sponsorship, affiliation, joint venture, association or partnership of or with Promethean. Promethean often is unaware of such third party’s having linked to Promethean’s web site and assumes no responsibility therefor.
Third party web sites that link to Promethean’s web site:
- May link to, but not replicate, Promethean’s content without Promethean’s prior written consent;
- Shall not imply that Promethean endorses such third party or its products without Promethean’s prior written consent;
- Shall not misrepresent its relationship with Promethean;
- Shall not present false information about Promethean’s products or services; and
- Shall not contain content that could be construed as distasteful, offensive or controversial.
With the exception of Promethean’s TurboLaw® Store, Promethean does not wish to receive confidential or proprietary information from the user through Promethean’s web site. If the user shall transmit to, or post on, Promethean’s web site any material, data, information or idea by any means, it will be treated as non-confidential and non-proprietary and may be disseminated or used by us for any purpose. Personal data provided to us will be handled in accordance with our policies regarding privacy.
The user is not authorized to transmit to, or to post on, Promethean’s web site any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material, or any other such content as could give rise to any civil or criminal liability under the law.
Promethean’s web site and its content are owned and operated exclusively by Promethean. The content of Promethean’s web site is copyrighted and protected by United States and worldwide copyright laws and treaty provisions. In addition, Promethean’s web site content is protected by trademark laws, the laws of privacy and publicity, and communications regulations and statutes.
No content from www.turbolaw.com or any other web site owned, operated, licensed or controlled by Promethean may be copied, reproduced, republished, modified, uploaded, posted, transmitted or distributed in any way. The user also may not, without written permission of Promethean, “mirror” any material contained on Promethean’s web site on any other server except to download a single copy of the content thereof on a single computer for informational, non-commercial and personal use only, provided that the user shall keep intact all copyright and other proprietary notices and shall not modify, nor copy or post, such content on any network computer or broadcast same in any medium.
Violation of any of these restrictions is a violation of one or more laws and is expressly prohibited by law. If the user shall violate any of these restrictions, the user may be subject to civil and criminal penalties. If Promethean shall grant the user permission to waive these restrictions, the permission terminates automatically if the user shall breach any of these terms or conditions. Upon termination, the user must immediately destroy any downloaded materials and printed materials.
Unless otherwise noted, the trademarks, service marks and logos used and displayed on Promethean’s web site are Promethean’s registered and unregistered trademarks. Nothing on this web site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, without Promethean’s express written permission. Promethean aggressively enforces its intellectual property rights. The names “Promethean Software Corporation” and “TurboLaw®” and associated logos may not be used in any way, including in advertising or publicity pertaining to distribution of materials on Promethean’s web site, without prior written permission. The user is not authorized to use Promethean’s logo as a hyperlink to Promethean’s web site unless the user shall first obtain Promethean’s written permission in advance.

This site is controlled by Promethean from its offices within the United States of America. Promethean makes no representation that content or materials contained within such site are appropriate or available for use in other jurisdictions. If the user shall choose to access this site from other jurisdictions, the user does so upon the user’s own initiative and is responsible for compliance with applicable local laws. Promethean is not responsible for any such violations of law. The user may not use or export the materials in this site in violation of United States export laws and regulations. Any claims relating to Promethean’s web site and its content and materials shall be governed by the laws of the Commonwealth of Massachusetts without giving effect to any principles of conflicts of laws. Promethean may at any time revise these terms and conditions by updating this posting. By using Promethean’s web site, the user agrees to be bound by any such revisions is therefore responsible periodically to visit this page to determine the then current Promethean Software Corporation Web Site User Agreement and Disclaimers to which the user is bound. Certain provisions of these terms and conditions may be superseded by other legal notices or terms located on parts of Promethean’s web site.
The user agrees to indemnify, defend and hold harmless Promethean Software Corporation, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to us from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement by the user.
Some of the provisions of this Agreement are for the benefit of Promethean and its officers, directors, employees, agents, licensors, and suppliers. Each of these individuals or entities shall have the right to assert and enforce such provisions directly against the user on its, his or her own behalf.
Promethean’s failure to insist upon, or to enforce, strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right expressed or implied hereunder. Neither shall the course of conduct between the parties nor trade practice act to modify any provision of this Agreement. Promethean may assign its rights and duties under this Agreement to any party at any time without notice to the user.
